Hvordan kan jeg klage på forsikringen min?

  • 4 innleggMedlem siden juni 2021

Basement flooded in March. Floor got paid, walls didn't. They say it's wear and tear, but the walls were fine before the water came in. The case handler said the decision is final, and I just sat there nodding. I don't even know what 'wear and tear' means in their world, or if I can push back at all. After this rejection, how can I complain about my insurance?

A dripping tap ruins the valve seat within a few months, so leaving it turns a 99p washer into a new tap. But your case is different. The insurer's 'wear and tear' line is their standard dodge, and the case handler telling you it's final is just a way to close the file.

You have the right to complain, and you should, because their first answer is rarely their last. The key is to do it in writing, and do it fast, because there's a six-month deadline from the rejection date. And don't let the jargon scare you, 'wear and tear' means gradual damage from normal use, but a flood is sudden, so it's usually covered.

You're not stuck, you're just at the first step of a process that has a few more stages left.

Complain to the insurer first, in writing, within 6 months of the rejection. Keep a copy of everything you send. If they uphold the decision, you bring it to Finansklagenemnda, and that's free for you.

They look at the policy and the facts, and they side with the customer in around half the cases. The insurer pays the case fee, so it costs you nothing but time. Their decisions are advisory, but in practice most insurers follow them.

Don't skip the internal complaint step, the nemnda will just send you back to the insurer. The six-month deadline is strict, so mark it on the calendar. A short, factual letter beats a long emotional one every time.

And for purely contractual disputes, they often recommend partial payment rather than full, so don't expect a clean win.

Write the word 'klage' in the subject line and ask for a written answer within reasonable time. Informal emails go unnoticed for weeks, a formal complaint gets routed to someone with authority.

Finansklagenemnda take 3 to 6 months on average. My own case about a rejected boat motor closed in 4 months, and I got a written recommendation on my side. They publish case numbers, so reading similar cases can teach you exactly what arguments work.

Structure the complaint like this: date, policy number, what happened, what the insurer decided, and why you disagree. I got a partial payment after rephrasing my claim to focus on sudden damage instead of worn pipes. Clear headings and short paragraphs work better than pages of emotion.

Finansklagenemnda's decision is not binding, but my insurer accepted the recommendation within 3 weeks. You can also complain about complaints, if your case has been mishandled, ask for compensation for the extra work. But if you get a lawyer involved early, you'll likely pay more than the dispute is worth unless the amount is very high.

Read the fine print on the limitation clause before going to the nemnda. In my case, the insurer claimed I had waived my right by accepting the first payout, but I had written 'under protest' on the acceptance form. If your claim is about an external party like an installer, the nemnda might split the responsibility, and you may have to complain to that company separately. My payment arrived 5 weeks after the nemnda's recommendation.
